Article 1 – Definitions

Reflection period: the period during which the consumer may exercise the right of withdrawal.

Consumer: the natural person who does not act in the exercise of a profession or business and enters into a distance agreement with the entrepreneur.

Day: calendar day.

Continuous transaction: a distance agreement relating to a series of products and/or services where delivery and/or purchase obligations are spread over time.

Durable medium: any instrument enabling the consumer or entrepreneur to store information addressed personally to them in a way accessible for future consultation and unchanged reproduction.

Right of withdrawal: the possibility for the consumer to cancel the distance agreement within the reflection period.

Model withdrawal form: the model form for withdrawal provided by the entrepreneur.

Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance.

Distance agreement: an agreement concluded within a system organized by the entrepreneur for distance selling of products and/or services.

Means of distance communication: a method used to conclude an agreement without the consumer and entrepreneur being present in the same place.

Terms and Conditions: the present general terms and conditions of the entrepreneur.

Article 3 – Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance agreement concluded between the entrepreneur and the consumer.

Before the distance agreement is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated where the terms can be inspected and they will be sent free of charge upon request.

If the agreement is concluded electronically, the terms and conditions may be provided electronically in such a way that the consumer can easily store them on a durable medium.

If one or more provisions of these terms become invalid, the remaining provisions will remain in force.

Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be clearly stated.

The offer is non-binding. The entrepreneur may modify the offer.

The offer contains a complete and accurate description of the products and/or services offered. Images are a truthful representation of the products offered, but colors may differ from the actual product.

  • The price including taxes
  • Possible shipping costs
  • The method of payment, delivery and execution
  • Whether the right of withdrawal applies
  • The period for accepting the offer
  • Available languages of the agreement
  • The minimum duration of the agreement if applicable

Article 5 – The Agreement

The agreement is concluded when the consumer accepts the offer and meets the stated conditions.

If acceptance takes place electronically, the entrepreneur will confirm receipt electronically.

The entrepreneur may refuse an order or attach special conditions if there are reasonable grounds.

Article 6 – Right of Withdrawal

For Products

The consumer may cancel the agreement within 14 days without giving any reason. The reflection period starts the day after the product is received.

The product must be returned with all supplied accessories and in its original condition and packaging where reasonably possible.

For Services

The consumer may cancel a service agreement within 14 days after the agreement has been concluded.

Article 7 – Costs in Case of Withdrawal

The consumer bears the direct costs of returning the product.

Payments will be refunded within 14 days after withdrawal, provided the returned product has been received or proof of shipment has been provided.

Article 8 – Exclusion of the Right of Withdrawal

The entrepreneur may exclude the right of withdrawal for certain products including:

  • Products made to consumer specifications
  • Special order products
  • Products of a personal nature
  • Products that cannot be returned due to their nature
  • Products that spoil quickly
  • Audio/video recordings or software with broken seals
  • Hygiene products with broken seals

Article 9 – Price

Prices will not increase during the validity period of the offer except due to changes in VAT rates.

All prices include VAT.

Printing and typographical errors are reserved.

Article 10 – Conformity and Warranty

The entrepreneur guarantees that the products comply with the agreement and the specifications stated in the offer.

Manufacturer warranties do not affect statutory consumer rights.

Article 11 – Delivery and Execution

The entrepreneur will take the greatest possible care in processing and delivering orders.

Orders will be executed as quickly as possible and no later than 30 days unless otherwise agreed.

Article 12 – Continuous Transactions

The consumer may terminate agreements concluded for an indefinite period at any time with a notice period of one month.

Article 13 – Payment

Unless otherwise agreed, payments must be made within 7 working days after the reflection period begins.

The consumer must report inaccuracies in payment details immediately.

Article 14 – Complaints Procedure

Complaints must be submitted within 2 months after the defect has been discovered.

Complaints will be answered within 14 days.

Article 15 – Disputes

All agreements are governed exclusively by Dutch law.

The Vienna Sales Convention (CISG) does not apply.

Article 16 – Additional or Deviating Provisions

Additional provisions may not be detrimental to the consumer and must be recorded in writing.

Article 17 – Product Use Warning

Motor and automotive racing are extremely dangerous sports. Our products do not guarantee protection against injury or fatal accidents.

Products intended for off-road use are not approved for use on public roads.

The consumer is responsible for obtaining sufficient information regarding the correct use of products.

The entrepreneur is not liable if racing products are used on public roads or if road products are used for racing purposes.
